Terms and Conditions
These Terms & Conditions apply to customised website design services provided by Melt Productions.
By accepting a quotation, making payment or instructing Melt Productions to commence work, the client acknowledges that they have read, understood and agreed to these Terms & Conditions.
1. Website Design Services
Melt Productions provides customised website design services tailored to the client's business, branding, content and agreed website requirements.
Melt Productions has experience designing websites using: Wix • Squarespace • Shopify • WordPress.
Clients may nominate their preferred website platform or request guidance from Melt Productions regarding a suitable platform based on their business and website requirements.
Any recommendation is based on the information provided by the client and the functionality available at the time. Melt Productions cannot guarantee that a particular platform will accommodate every current or future business requirement.
2. Website Packages and Pricing
Melt Productions currently offers the following website design packages:

These are fixed package prices for the inclusions specifically stated within each package and are not starting or "from" prices.
Any services, pages, functionality, integrations, revisions or requirements beyond the advertised package inclusions are considered additional work and will either incur an applicable add-on fee or be quoted separately.
Melt Productions will communicate additional costs and obtain client approval before undertaking chargeable work outside the agreed package scope.
3. Package Scope
The client's selected website package covers only the pages, services and functionality specifically included within that package.
The client acknowledges that the advertised package price does not provide unlimited website design services.
Requests that substantially increase the scope, complexity or time required to complete the website may incur additional charges.
This may include:

4. Website Add-Ons
Additional services may be purchased where required.
Current add-on pricing includes:
Additional Pages – From $120 per page
For additional service, information, landing or content pages beyond the number included within the selected package.

Website Copywriting – From $80 per page
Professional website copywriting tailored to the client's business, services and brand voice.
E-Commerce / Online Store Setup – From $400
Available as an add-on to the Website Starter or Business Website packages. Standard online store setup is already included within the Complete Website package.
Booking Functionality – From $200
Available as an add-on to the Website Starter package. Standard booking functionality is included within the Business and Complete Website packages.
Blog Setup – From $150
Setup and configuration of a dedicated blog, news or updates section where not otherwise included.
Additional Forms – From $75 each
For additional enquiry, registration, application or information collection forms beyond the selected package inclusions.
Additional Revisions – $95 per hour
Applies where the client requires revisions beyond the three included revision rounds or requests substantial changes outside the original agreed brief.
Domain & Email Setup Assistance – From $100
Additional assistance with domain configuration, DNS settings or business email setup beyond standard domain connection assistance.
Advanced Functionality – Custom Quote
Including advanced integrations, memberships, databases, specialised forms, complex booking systems or other non-standard website requirements.

Ongoing Website Updates – Creative Partner Package or Custom Quote
Ongoing website changes, content updates and design support may be provided through a Melt Productions Creative Partner Package or separately quoted website support.
Add-on prices may vary depending on the complexity and scope of the client's requirements. Where an add-on is advertised as "From". Melt Productions will confirm the applicable price before commencing the additional work.
5. Payments
Unless otherwise agreed in writing, full payment is required before website design commences.
Work will not commence until the required payment has been received. Melt Productions may suspend work where an invoice or payment remains outstanding.
Additional work and approved add-ons may be invoiced separately.

Clients may request to pay for a Website Design Package via invoice instead of completing payment by credit card or through the online checkout.

To request an invoice, clients must contact Melt Productions at info@meltproductions.au and advise which Website Design Package and any applicable add-ons they wish to purchase.

Where payment is made by invoice:

The selected Website Design Package must be paid in full before website design services commence.

No website design work will commence until cleared payment has been received and confirmed by Melt Productions.

Payment of the package invoice confirms the client's purchase of the package and acceptance of the applicable Website Design Terms & Conditions.

Payment covers only the inclusions specifically stated within the selected Website Design Package and any add-ons expressly included on the invoice or quotation.

Any additional pages, functionality, revisions, integrations, content creation or other work requested outside the agreed scope will be treated as an add-on or out-of-scope work and may be invoiced separately.

Additional or separately quoted work must be paid before that additional work is undertaken, unless otherwise agreed in writing.

Third-party costs including domain registration, hosting, platform subscriptions, premium applications, plugins and other external services remain the client's responsibility unless specifically included on the invoice.
Where payment has not been received, Melt Productions is not required to schedule, reserve capacity for or commence the website project.
Project timeframes provided before payment are indicative only. Any estimated commencement or completion date may need to be adjusted depending on Melt Productions' availability at the time payment is received.
Except where required under Australian Consumer Law, the same cancellation, refund and service conditions apply regardless of whether payment is made by credit card, online checkout or invoice.
6. Website Platforms
The client may select their own or from a website platform supported by Melt Productions, including Wix, Squarespace, Shopify and WordPress.
The selected platform may affect the functionality, design capabilities, hosting requirements, applications and ongoing costs associated with the website.
Melt Productions is not responsible for changes made by third-party website platforms, including changes to:

Features
-
Functionality
-
Subscription plans
-
Applications

Plugins
-
Integrations
-
Platform policies
-
Availability or outages
Where a platform changes or removes functionality following completion of the website, any work required to modify or replace that functionality may be quoted separately.
7. Domain Names
The choice of website domain name and domain provider remains with the client.
Clients may use an existing domain or purchase a new domain through a provider of their choice.
Melt Productions can provide standard assistance connecting the client's domain to the completed website where included within the package.
Melt Productions cannot guarantee that a requested domain name will be available.
Wherever practical, domain names should be registered directly in the client's name and account so that the client maintains ownership and control.
Domain registration and renewal fees are not included within website package pricing.
8. Hosting, Subscriptions and Third-Party Costs
Unless specifically stated otherwise, website package pricing does not include:

These costs are payable by the client.
Wherever practical, third-party accounts and subscriptions should be established in the client's name so the client maintains ownership and control.
9. Client-Supplied Content
Unless website copywriting, photography, content creation or another content service has been specifically purchased, the client is responsible for supplying the content required to design their website.
This may include:

Service descriptions

Other relevant website content
Content must be supplied in a suitable format and within a reasonable timeframe.
Melt Productions is not responsible for project delays caused by missing, incomplete or late client-supplied content.
10. Content Accuracy and Intellectual Property
The client is responsible for ensuring all information supplied to Melt Productions is accurate, current, lawful and authorised for use.
The client must hold appropriate rights or licences for photographs, videos, logos, graphics, fonts, written material and other content supplied for inclusion on the website.
Melt Productions is not responsible for copyright, trademark or other intellectual property issues resulting from content supplied or specifically requested by the client.
11. Revisions
Each website package includes up to three (3) rounds of revisions.
A revision round consists of reasonable amendments to the existing website design based on the original agreed brief.
Revision rounds are intended for refinements and adjustments and do not constitute unlimited redesign.
The following may be considered additional work rather than a standard revision:

Additional revisions are charged at $95 per hour, unless separately quoted.
12. Booking Functionality
Standard booking functionality is included within The Business Website and The Complete Website packages.
Booking functionality may also be added to The Website Starter from $200.
Standard booking functionality generally refers to configuring suitable booking features available through the selected website platform or an agreed third-party application.
The exact booking requirements will be confirmed during the project.
Complex requirements may incur additional fees, including:

External software integrations

13. E-Commerce and Online Store Setup
Standard e-commerce/online store setup is included within The Complete Website package.
E-commerce functionality may be added to The Website Starter or Business Website packages from $400.
Standard store setup may include basic store configuration, product structure, standard payment setup and standard platform-supported e-commerce functionality.
The exact number of products and agreed store requirements will be confirmed as part of the project scope.

The client is responsible for supplying accurate product descriptions, pricing, product images, shipping information and other required store content unless otherwise agreed.
Payment processing, merchant fees and transaction fees remain the responsibility of the client.
14. Search Engine Optimisation (SEO)
Where included, basic SEO setup may include reasonable configuration of:

Page headings
-
Image descriptions/alt text where appropriate

Search-friendly page structure

Other basic SEO settings available through the selected website platform
Basic SEO setup does not constitute an ongoing or advanced SEO service.
Melt Productions does not guarantee any particular Google ranking, search engine position, website traffic, enquiries, sales or other SEO outcome.
Advanced SEO services may be quoted separately.
15. Third-Party Integrations
Where included or separately purchased, Melt Productions may assist with connecting third-party applications and services.
Third-party integrations remain subject to the functionality, availability, pricing and terms of the relevant provider.
Melt Productions cannot guarantee the ongoing operation or compatibility of external platforms, plugins, applications or integrations.
Technical issues resulting from third-party services following website completion may require additional paid support.
16. Website Testing and Client Approval
Before launch, the client will be given an opportunity to review the website and request eligible final revisions.
The client is responsible for carefully reviewing and approving:

Final client approval confirms that the client is satisfied with the website and authorises Melt Productions to proceed with launch or handover.
17. Website Launch
The website will not ordinarily be launched, transferred or handed over until all outstanding project fees have been paid.
The client is responsible for ensuring required hosting, platform subscriptions, domain services and relevant third-party services are active before launch.
Melt Productions is not responsible for launch delays caused by client delays, domain providers, hosting providers, website platforms or other circumstances outside its reasonable control.
18. Post-Launch Support
Where included, the Complete Website package provides 14 days of post-launch support from the website launch or formal handover date.
Post-launch support is intended to address reasonable corrections relating to the original website design.
It does not include:

-
New content
-
New products
-
Redesign requests
-
Ongoing website maintenance

Changes to the original brief
-
Issues caused by changes made by the client or another provider
-
Issues caused by third-party platform changes
Additional work may be completed at the applicable rate or quoted separately.
19. Ongoing Website Maintenance
Ongoing website maintenance is not included within the website package unless specifically stated.
Clients requiring ongoing design, content or website updates may engage Melt Productions through a Creative Partner Package or request a separate quotation.
20. Project Timeframes and Client Delays
Website completion timeframes will vary depending on the selected package, project complexity, client responsiveness and availability of required content.
Any timeframe provided by Melt Productions is an estimate unless expressly agreed otherwise in writing.
Where a client significantly delays providing content, feedback or approvals, Melt Productions may reschedule the project based on current availability.
Projects that remain inactive for an extended period may require a revised completion timeframe and, where the project scope or costs have materially changed, an updated quotation.
21. Additional and Out-of-Scope Work
Work outside the agreed website package or project scope may be charged at $95 per hour or quoted separately depending on the nature of the work.
Melt Productions will advise the client before undertaking additional chargeable work wherever reasonably possible.
The client must approve additional fees before that work commences.
22. Ownership and Website Handover
Upon full payment of all outstanding amounts, the client will receive the agreed website and final client-specific materials in accordance with the selected platform and project scope.
Wherever practical, the client's domain, website subscription, hosting and relevant third-party accounts will remain in or be transferred to the client's control.
Melt Productions retains ownership of preliminary concepts, rejected designs, internal working files, processes and materials not included in the final deliverables.
Third-party themes, fonts, applications, plugins, stock assets, software and templates remain subject to their respective licence terms.
23. Portfolio and Promotional Use
Unless otherwise agreed in writing, Melt Productions may display the completed website, screenshots or selected design elements within its portfolio, website, social media and promotional materials.
Melt Productions will not knowingly disclose confidential or commercially sensitive client information through portfolio use.
24. Website Security and Ongoing Responsibility
Melt Productions will take reasonable care when configuring the website within the agreed project scope.
However, no website, hosting provider or online platform can be guaranteed to be completely free from outages, security vulnerabilities, malicious activity or technical issues.
Following website handover, the client is responsible for maintaining appropriate passwords, account security, subscriptions, updates, backups and other ongoing website requirements applicable to their chosen platform.
25. Legal Policies and Compliance
The client is responsible for determining which legal notices, policies, disclosures and regulatory information are required for their website and business.

Unless specifically agreed otherwise, Melt Productions does not provide legal advice and does not guarantee that client-supplied policies or website content satisfy the client's legal or regulatory obligations.
26. Website Performance and Business Outcomes
Melt Productions will provide website design services with reasonable care and skill in accordance with the agreed project scope.
Melt Productions does not guarantee any specific level of website traffic, enquiries, bookings, leads, sales, revenue, search engine rankings or other commercial results.
27. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where these Terms & Conditions conflict with a mandatory legal requirement, that legal requirement will prevail.
28. Changes to These Terms
Melt Productions may update these Website Design Terms & Conditions from time to time.
The Terms & Conditions applicable to a project will generally be those accepted by the client when the project is confirmed, unless otherwise agreed or a change is required by law.
29. Acceptance
By accepting a website quotation, making payment or instructing Melt Productions to commence work, the client confirms acceptance of these Website Design Terms & Conditions.
